  • Odisha state assembly has given the nod for creation of legislative council on 6th September. The proposed council will have 49 members which is 1/3rd of the number of legislative assembly.
  • 104 out of 147 members have cast their votes. Biju Janta dal leader, Naveen Patnayak, CM of Odisha has claimed that this step will bring more democratic environment in the policy making.

Legislative Council-

  • Under article 169 of the constitution, a legislative council can be formed “ if the legislative assembly of the state passes a resolution to that effect by a majority of the total membership of the assembly and by a majority of not less than two-thirds of the members of the assemble present and voting”. Parliament can then pass a law to this effect.
  • Under Article 171 of the constitution, the legislative council of a state shall not have more than one-third of the total number of MLAs of the state, and not less than 40 members.
  • An exception is there in Jammu& Kashmir where MLAs are 89(87+2 nominated) in numbers while the legislative council has only 36 members.
