  • On 10th January 2019, Right of Children to Free and Compulsory Education (Amendment) Act, 2019 received the assent of the President of India and has been notified in the Gazette of India. It was passed by the Parliament on 3rd January 2019.
  • Right of children to free & Compulsory Education (Amendment) Act, 2019 abolishes the no-detention policy in schools (automatic promotion) unlike guaranteed by RTE Act, 2009 regarding elementary education (Class 1-8).
  • Four sections have been substituted in the section 16 of Right of Children to Free and Compulsory Education Act, 2009.
  • As of now provisions made by amended act, there shall be a regular examination for Fifth & Eighth classes at the end of every academic year.
  • Child failing the examination shall be given additional opportunity for re-examination within a period of two months provided with two-month remedial teaching from the date of declaration of the result.Children failing the re-exam would be left to the States to decide whether to continue the no-detention policy.
  • This move was supported by 25 states, as per Human Resource Development Minister Prakash Javadekar.
  • The Right of Children to Free and Compulsory Education Act, 2009 (the Act) provisions for free and compulsory education to all children of the age of six to fourteen years.
