Proposal of the report

  • The proposal in the report is that media platforms (Facebook, WhatsApp, YouTube and Twitter) would be made accountable for not blocking such malicious videos and posts when it comes under their notice.
  • And, FIR could be made against their respective heads for non-compliance of government orders and they could be prosecuted under law as well.

Necessity for anti-lynching law

  • Currently, there is no law in the Indian Penal Code which criminalizes killing by mob.
  • There is a provisions for rioting, unlawful gathering and, murder but not for mob- killing (a group of people coming together to kill a person).
  • There is a provision under section 223(a) in the code of Criminal Procedure, 1973 to litigate together two or more people accused of the same offence in the course of the same transaction. But the legal framework of this provision is not adequate to litigate accused mobs.
